How are covenants and rules enforced?

Violations of covenants and rules are generally enforced through a three-step process.

  1. Discovery. The on-site property manager is responsible for performing regular inspections throughout the community to catch infractions. This obviously won’t catch 100% of the violations, so residents are also encouraged to report observed infractions to the property manager with as much detail as possible.
  2. Notice. The property manager will send notice to the offending party, alerting them to the violation, providing information on what must be done to correct the violation, indicating how much time they have to correct the violation, and assessing any fines.
  3. Fines. The violation notice may include a fine, per the Association’s Fines Policy. Fines will continue to be levied until the violation is corrected. Fines will be enforced just like unpaid HOA assessments (i.e., through collections and property liens).
